Terms of Service

The short version: Swiftly is an interviewer-side tool. You are responsible for how you use it, including any disclosure obligations to candidates under applicable law. We provide the service as-is; we are not liable for hiring decisions made using it.

1. Acceptance of terms

By accessing or using Swiftly ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. What Swiftly is

Swiftly is a real-time coaching tool for interviewers. It listens to your device microphone during a technical interview and surfaces follow-up question suggestions to help you assess genuine candidate understanding. It is an interviewer-side tool that runs in your browser; it is not a candidate-facing product and does not integrate with meeting platforms.

3. Authorised use

You may use Swiftly only for lawful interviewing purposes within your own organisation or as an authorised agent of an organisation. Specifically, you must not:

Use Swiftly to collect, store, or process candidate data beyond what is described in our Privacy Policy.
Use Swiftly to make or automate hiring decisions — all decisions remain yours as the interviewer.
Infer, record, or report on candidate emotion, mental state, or any protected characteristic.
Use Swiftly in jurisdictions where doing so would violate applicable employment, data protection, or AI regulation law without first obtaining all required consents and completing any required compliance steps.
Resell, sublicense, or provide access to the Service to third parties.
Reverse-engineer, scrape, or attempt to extract the underlying AI models or prompts.

4. Disclosure to candidates

Laws governing AI-assisted tools in employment contexts vary by jurisdiction. In some places — including certain US states, the EU (AI Act, Article 5), and jurisdictions with all-party consent recording laws — you may be required to disclose to candidates that an AI tool is assisting your interview process.

You are solely responsible for determining and complying with any applicable disclosure or consent obligations in your jurisdiction. Swiftly does not provide legal advice. If you are uncertain, consult a qualified employment lawyer before using the Service in interviews.

5. Credits and payment

Swiftly operates on a credit system. New accounts receive a free credit allocation on signup. Additional credits are purchased via Razorpay. Credits are non-refundable once consumed. Unused credits expire 12 months after purchase. Pricing is displayed at the point of purchase and may change with notice.

6. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service depends on third-party providers (Sarvam AI, Google Cloud, Anthropic) whose availability we do not control. We are not liable for losses arising from service unavailability during an interview.

7. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE COACHING SUGGESTIONS GENERATED BY SWIFTLY ARE ACCURATE, COMPLETE, OR APPROPRIATE FOR ANY PARTICULAR CANDIDATE OR ROLE. ALL HIRING DECISIONS ARE MADE SOLELY BY YOU.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOWCRAFT SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO HIRING DECISIONS, MISSED CANDIDATES, OR CLAIMS ARISING FROM CANDIDATES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE CLAIM.

9. Intellectual property

All rights in the Service, including the coaching AI, the user interface, and the Swiftly brand, are owned by Flowcraft Systems. Using the Service does not grant you any intellectual property rights. Coaching output generated during your sessions is yours to use for your own interviewing purposes.

10. Termination

We may suspend or terminate your account if you breach these Terms. You may delete your account at any time by contacting hello@flowcraft.systems. On termination, your credits are forfeited and your data is handled per our Privacy Policy.

11. Governing law

These Terms are governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated by updating the effective date above. Continued use after an update constitutes acceptance of the revised Terms.
